The Scaling Society, a brand of Kubisa LLC ("we," "us," "our"), respects your privacy. This Privacy Policy explains what information we collect, how we use it, and the choices you have. It applies to ngunza.com and any related Scaling Society / Kubisa LLC properties (collectively, the "Site").

Mobile information & SMS: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information collected on this Site exclude mobile opt-in data and consent. Information sharing with subcontractors is limited solely to providing the messaging service itself (for example, our SMS delivery vendor).

1. Information We Collect

We collect the following categories of information:

Information you provide directly — your first name, mobile phone number, email address, business details, and any other information you submit through forms or chat on the Site.
SMS opt-in data — your mobile number, the consent checkbox(es) you selected, the date and time of consent, and the URL on which you consented.
Automatically collected data — IP address, browser type, device type, referring URL, pages viewed, and time spent on pages, collected through cookies and similar technologies.
Communications — messages you send us through chat, email, or SMS reply.

2. How We Use Your Information

To respond to chat conversations and inquiries you initiate.
To send the categories of text messages you opted in to receive (account/transactional, marketing, or both).
To provide, operate, and improve The Scaling Society program and Site.
To send appointment reminders, webinar reminders, and account notifications if you opted in to transactional messages.
To send promotional offers, deal alerts, and education content if you opted in to marketing messages.
To comply with legal obligations and enforce our Terms of Service.

3. SMS / Text Messaging

If you provide your mobile number and check one or both consent boxes on our opt-in form, you agree to receive the categories of text messages you selected from The Scaling Society. SMS terms:

Message frequency: varies based on the categories you opted in to. Marketing messages are limited to approximately 5 per week. Transactional messages are sent only when triggered by your activity (e.g., webinar reminders).
Cost: Message and data rates may apply. Check with your mobile carrier.
Help: Reply HELP to any message for support, or email support@ngunza.com.
Opt out: Reply STOP to any message at any time to unsubscribe. You will receive a confirmation, and we will not send further marketing or transactional messages to that number.
Carriers: Carriers (T-Mobile, AT&T, Verizon, etc.) are not liable for delayed or undelivered messages.
Consent is optional and is not a condition of any purchase. You may opt out at any time without affecting your access to the rest of the Site or program.

Third-party sharing — explicit statement: We do not sell, rent, lease, share, or otherwise disclose your mobile phone number, SMS opt-in status, or SMS consent data to any third parties or affiliates for marketing or promotional purposes. The only entities that may receive your mobile information are our SMS delivery subcontractors (such as Twilio and LeadConnector / GoHighLevel), and only for the purpose of delivering the messages you opted in to.

4. Cookies & Analytics

We use cookies and similar technologies to operate the Site, remember your preferences, and understand how the Site is used. You can disable cookies in your browser settings; some Site features may not work without them.

5. Service Providers

We use trusted third-party providers to operate the Site and program, including:

GoHighLevel / LeadConnector — chat widget, contact management, SMS delivery.
Twilio — A2P 10DLC SMS messaging carrier.
Vercel — Site hosting.
Stripe / Fanbasis — payment processing (only if you become a member).

These providers process information only as needed to perform their service and are bound by confidentiality and data protection obligations.

6. Information Sharing

We do not sell your personal information. We share personal information only:

With service providers listed above, solely to operate the Site and deliver the services you requested.
To comply with applicable law, legal process, or enforceable governmental request.
To protect the rights, property, or safety of The Scaling Society, our members, or others.
